Los Angeles DA Gascón recommends Menendez Brothers resentencing

Los Angeles County District Attorney George Gascón has recommended the resentencing of Erik and Lyle Menendez, who have been in custody for over 30 years following their convictions for the 1989 murders of their parents, Jose and Kitty Menendez.

This decision comes after new evidence surfaced, including allegations that the brothers were sexually molested, which was not fully understood during their original trials. Gascón acknowledged the complexity surrounding sexual violence and the brothers’ rehabilitative efforts while incarcerated.

Today, as we move forward with the resentencing of Erik and Lyle Menendez who have spent 35 years behind bars after being convicted in 1996 for the killing of their parents, Jose and Kitty Menendez, we must acknowledge the deep pain and suffering experienced by the victims’ families,” Gascón said in the release.

“We also acknowledge Erik and Lyle’s continuous rehabilitative efforts during their incarceration,” he added.

The case, which shocked the nation in the early ’90s, saw the brothers convicted of first-degree murder and conspiracy to commit murder. Now, a Los Angeles Supreme Court judge will determine if they should be formally resentenced, potentially making them eligible for parole.

Kim Kardashian, a vocal advocate for criminal justice reform, expressed her support for the decision, sharing on Instagram her gratitude to Gascón for addressing the case.

Kardashian released a statement on Instagram.

“Society’s understanding of child abuse has evolved, and social media empowers us to question the system in place,” she wrote, in part. “This case highlights the importance of challenging decisions and seeking truth, even when guilt is not in question.”

She also wrote, “Thank you, George Gascón for revisiting the Menendez brothers’ case and righting a significant wrong. Your commitment to truth and fairness is commendable. To the brother’s family, friends, and millions who have been vocal supporters — your voices were heard. The media’s focus, especially on the heels of Ryan Murphy’s TV show, helped expose the abuse and injustices in their case.”



If the recommendation is approved, the Menendez brothers could be eligible for parole as early as six months from now. The hearing date is yet to be determined.
